Do You Need to Establish a Guardianship in Los Angeles?

A guardian is a person appointed by the court to care for minor children.  The need may arise because the parents have died. In this instance, the court will usually appoint as guardian the person the parents named in their will but upon good cause shown may appoint another. The court does what is in the best interests of the child. 

In guardianship cases where the parents are alive, the competency to the parents may have been called into question.  If after investigation, the court has determined the parents to be unfit, it may appoint another such as a grandparent as the guardian. 

When you apply to be a guardian of a child, you begin by filing a petition with the court.  The court will order an investigation where you, the parents and, if old enough, the child will be interviewed.  Then there will be a hearing in which the court will make a decision as to what is in the child's best interests.
